National Labor Relations Board and Revisions to Severance Agreements

The National Labor Relations Board issued a decision on McLaren Macomb and Local 40 RN Staff Council, on February 21, 2023 concluding that severance agreements may be deemed unlawful if they broadly restrict an employee’s ability to speak about the agreement or disparage their employer. 

In this video, I am discussing the NLRB decision, and whether businesses may need to reconsider the confidentiality and non-disparagement clauses in severance agreements.
