Three Things Businesses Should Consider Before Firing Employees

  1. If the business is terminating for performance or violation of company policy- Have you discussed the issue with the employee; counseled him/her on the problem and what needs to be done to fix it- jumping to a termination without trying to resolve the issue through training or manager meetings can lead to high turnover costs and lawsuits against the company
  2. Has the employee engaged in a protected activity, such that firing the employee would be retaliatory- protected activities are things like complaints about discrimination, harassment, complaints about non-payment of wages or overtime, requests for accommodations based on a disability- like anxiety, depression, or a medical condition constituting a disability.
  3. Consider the Cost to replace the employee- a Gallup survey estimates the cost to replace employees is ½ to 2 times the employees annual salary

Many companies are quick to fire and don’t go through the proper considerations. Businesses should consult with an employment lawyer before making any substantial employee decisions, to make sure its following the law.
